Please read these SMS Terms and Conditions ("Terms") carefully before opting in to the High Performance Mechanical SMS messaging program. By opting in, you ("End User," "You," or "Your") agree to these Terms. High Performance Mechanical is a trade name (DBA) of Wolf Restorations ("the Company," "We," "Us," or "Our"). The Company operates this SMS messaging program to communicate with customers regarding HVAC services.



1. DESCRIPTION OF SMS USE CASES


By opting in to our SMS messaging program, You agree to receive text messages from High Performance Mechanical for the following specific purposes:


1.1 Appointment Reminders and Confirmations

We will send You text messages to remind You of upcoming HVAC service appointments, confirm scheduled appointments, notify You of technician arrival times or delays, and confirm appointment rescheduling or cancellations.


1.2 Service Updates and Notifications

We will send You text messages to provide updates on the status of ongoing HVAC repairs or installations, notify You when parts have arrived or when a follow-up visit is needed, send completion notifications after service has been performed, and deliver equipment maintenance reminders based on manufacturer recommendations or Your service history.


1.3 Seasonal Offers and Promotional Messages

We may send You text messages containing seasonal HVAC maintenance offers and discounts, promotional pricing on heating and cooling system tune-ups, special offers on new equipment installations or upgrades, and limited-time service deals and referral program information.


1.4 Customer Support Communications

We may send You text messages in response to Your inquiries or support requests, including answers to service questions, invoice and payment confirmations, and follow-up satisfaction surveys.


You will not receive SMS messages from High Performance Mechanical for any purpose other than those described above unless we update these Terms and provide You with notice.



2. OPT-IN CONSENT


By checking the consent box on our website, submitting a web form with Your mobile phone number, texting a keyword to our business phone number, or verbally providing consent during a phone call or in-person interaction, You acknowledge that:

Standard message and data rates may apply. Any charges for text messages or data usage are determined by Your wireless carrier and Your individual mobile phone plan. High Performance Mechanical is not responsible for any messaging or data fees charged by Your wireless carrier.


5.1 Message Frequency

The number of SMS messages You receive from High Performance Mechanical will vary depending on Your service activity, appointment schedule, and communication preferences. You can generally expect to receive up to 10 messages per month, though this number may be higher during active service periods or promotional campaigns.


5.2 Your Responsibility

You are solely responsible for any message and data charges that Your wireless carrier may impose in connection with SMS messages sent to or received from High Performance Mechanical. If You have questions about Your text messaging plan, data plan, or any charges that may apply, we recommend that You contact Your wireless carrier directly.


5.3 No Charge from Us

High Performance Mechanical does not charge any fee for participating in our SMS messaging program. The only costs You may incur are standard message and data rates as determined by Your wireless carrier.



6. CARRIER LIABILITY DISCLAIMER


Wireless carriers are not liable for delayed or undelivered messages. Delivery of SMS messages is subject to the effective transmission by Your wireless carrier. High Performance Mechanical does not guarantee that SMS messages will be delivered on time or at all, as message delivery depends on factors outside of our control, including:


• Your wireless carrier's network coverage, capacity, and service availability.

• Network congestion, outages, or technical difficulties experienced by Your carrier.

• Your mobile device being powered on, within coverage area, and able to receive text messages.

• Any filtering, blocking, or restrictions applied by Your wireless carrier.

• Interruptions caused by natural disasters, emergencies, or other force majeure events.


Neither High Performance Mechanical nor any wireless carrier shall be liable for any delays, failures to deliver, or errors in the content of any SMS messages. T-Mobile, AT&T, Verizon, and all other wireless carriers are not responsible for delayed or undelivered messages.


You acknowledge and agree that SMS messaging is not a guaranteed communication method and that time-sensitive or critical communications (such as emergency service requests) should be made by phone call rather than text message.



7. AGE RESTRICTION (18+)


You must be at least eighteen (18) years of age to opt in to the High Performance Mechanical SMS messaging program. By providing Your consent and opting in, You confirm and represent that:


• You are at least 18 years of age.

• You are the authorized account holder of the mobile phone number provided, or You have obtained explicit permission from the account holder to receive SMS messages at that number.

• If You are under the age of 18, You must obtain verifiable parental or legal guardian consent before opting in to our SMS messaging program.


High Performance Mechanical does not knowingly collect personal information from or send SMS messages to individuals under the age of 18 without parental consent. If we become aware that a person under 18 has opted in without proper consent, we will promptly remove their information and unsubscribe them from our SMS program.
